Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3161

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A judicial claim. A procedure directed to the court against the opposing litigant. It determines the scope of the action. The court must adhere to that scope when adjudicating the action. - The inadmissibility of new requests on appeal. Permissibility of changing the basis while retaining the original request. Example concerning equivalent performance. - An award of equivalent performance or compensation as a result of unjust enrichment. Its basis is the rules of tort liability, not the void contract. It entails a change to the cause of action, not a change to its subject matter.
