Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3419

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A judgment awarding something the parties did not request or more than they requested. The means of challenging it is a petition for reconsideration, not an appeal in cassation. Unless the court has explained its view of what it awarded and that it is aware of the true nature of its award and that the parties did not request it or that it exceeds what they requested, while insisting upon it.
