Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3437

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The legislature’s provision for termination of the proceedings at a particular level of litigation without appeal in cassation. Impermissibility of using a petition for reconsideration as a pretext for appeal in cassation. - A decision issued by the Court of Appeal assessing a lawyer’s fees—in the absence of a written agreement on their amount—is not subject to appeal. Consequence: challenging the decision by a petition for reconsideration does not permit an appeal in cassation against the judgment issued on that petition.
