Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3452

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Fraud upon which a petition for reconsideration is based. It is that whose circumstances remained concealed from the opposing party throughout the hearing of the action, such that he had no opportunity to present his defense concerning it and elucidate its truth to the court, and the judgment was influenced by it. Matters addressed in the litigation and debated between its parties, on the basis of which the court preferred one party's account over the other's and ruled in his favor, persuaded by his proof. A petition for reconsideration thereof is impermissible.
