Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3468

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An objection to a judgment by a person who is not a party to the proceedings. It is not a method of challenging the judgment by the party against whom it was rendered. It is regarded as a form of intervention in the proceedings which the legislature has afforded to a person against whom the judgment is binding, even though he was not joined in them. Article 158/1 of the Civil Procedure Law. Ruling that an objection to a judgment concerning entitlement to inheritance and establishment of heirship is inadmissible on the ground that judgments bind only their parties and that the appellants were not parties to the proceedings or represented in the judgment objected to, so it has no binding effect against them. A violation of the law requiring its cassation.
