English translation
A person against whom the judgment rendered in the action is binding, and who was neither joined nor intervened therein, may object to that judgment provided that he proves fraud, collusion, or gross negligence by the person who represented him. Joint and several creditors and debtors, and creditors and debtors under an indivisible obligation, may likewise object to a judgment rendered against another creditor or debtor among them. Article 159 (1) The objection shall be brought before the court that rendered the judgment through the ordinary procedures for bringing an action. Its statement must specify the judgment objected to and the grounds of objection; otherwise, it shall be void. The court considering the objection may be composed of the same judges who rendered the judgment. Upon submitting the objection, the objector must deposit, as security, fifty dinars if the judgment objected to was rendered by a summary court or the Court of First Instance, and one hundred dinars if it was rendered by the Court of Appeal. The registry shall not accept the statement of objection unless accompanied by proof of deposit of the security. A single security deposit shall suffice where there are multiple objectors if they bring their objection in a single statement, even if the grounds of objection differ. The government shall be exempt from depositing this security, as shall persons exempt from judicial fees. The security shall be forfeited by operation of law whenever a judgment is rendered declaring the objection inadmissible, impermissible, lapsed, or void.
