Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2738

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An objection to a judgment by a person who is not a party to the proceedings. Is not considered a method of challenging the judgment by the party against whom judgment was rendered. It is considered a form of intervention in the proceedings granted by the legislature to a person against whom the judgment is considered binding even though he was not joined therein. Article 158/1 of the Civil Procedure Law. A ruling that an objection to a judgment concerning the right to inherit and establishing heirship is inadmissible, on the basis that the binding force of judgments is limited to their parties and that the appellants were not parties to the proceedings or represented in the judgment subject to objection, which therefore has no binding force against them. A contravention of the law requiring its cassation.
