Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3867

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Precautionary attachment of the debtor’s assets held by third parties. Fear that the creditor will lose the security for his right is not a condition for imposing it, unlike precautionary attachment of the debtor’s movables. The reason: such fear is presumed in the former.
