State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An order permitting attachment of the debtor's property held by a third party. Its two conditions. The debt must be certain in existence and due for payment. The issuing judge, and thereafter the court hearing the grievance, must verify that both conditions are satisfied. Establishment that the debt is contingent, subject to a suspensive condition, seriously disputed, or not due for payment. The effect of this: issuance of the order must be refused, or judgment must be rendered cancelling it upon a grievance against it.
