Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4055

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Issuance of a letter of guarantee at the customer's request does not create for him a right to its value. The reason for this: the bank did not undertake to pay it to him but to guarantee him within its limits, nor does it represent a right of the customer against the beneficiary. The import of this. The customer cannot demand it, and his creditors may not attach it in the hands of the bank or the beneficiary. It does not enter the latter's patrimony unless he personally demands it within the limits of the bank's obligation and its conditions set out in the letter.
