Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4337

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The Fees Department may demand from the claimant the fees due on the action he brings or the application he makes until judgment is issued therein. The consequence: it is bound by the binding force of the judgment and therefore collects the fees from the litigant whom the court ordered to pay them. - Actions for yield, rent, and daily compensation are valued at the amounts due up to the date of submission of the statement of claim. The effect of that: judicial fees are due on those amounts. An example of sound reasoning for assessing judicial fees—in an action demanding consideration for use of the leased premises until completion of vacating them—on the amount due up to the date the action was brought.
Arabic original
