English translation of the principle

The unsuccessful party’s obligation to pay the costs of the action, which include judicial fees. The court awards them of its own motion. The implication: where judgment has been issued in the action and the party liable for its costs identified, the registry has the right to demand from the plaintiff the fees due from him, as the person obliged to advance the expenses of procedures he undertakes or which are undertaken at his request, or to demand them from the party liable therefor under the judgment issued on the merits of the dispute. If judgment is rendered against the opponent of the person exempt from fees, payment must first be demanded from that opponent. Example.
