Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 912

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A defence not founded on a sound basis in fact and law. The judgment need not respond to it. - 147 - Civil Procedure - The provision in Article 297 of the Civil Procedure Code requiring service of the travel-ban order on the person against whom it was issued within two weeks from the date of its issuance. Its implication. Affording the person against whom it was issued an opportunity to challenge it sufficiently in advance of his travel or to reach a settlement with the creditor, because the ban procedures take place in the debtor's absence. The creditor's failure to serve the debtor within that period. Does not entail lapse or nullity of the order. Omission of a response to the defence that the travel-ban order has lapsed because it was not served on the person against whom it was issued within two weeks from the date of its issuance. Does not vitiate the judgment. The reason therefor. Example.
