Kuwait Court of Cassation principle number 122
State of Kuwait · Recent Criminal Matters ·
English translation of the principle
Summary: - Statement of the facts of the case, its evidence, and the legal provision under which judgment was rendered. Not required for procedural judgments, such as declaring an appeal inadmissible because it was lodged by a person lacking standing. Rule: Since the challenged judgment declared the appeal brought by each of the appellants inadmissible because it was lodged by a person lacking standing, the appellants’ objection to that judgment for failing to state the facts of the case, its evidence, and the legal provision under which it ruled—in respect of them—is misplaced. Such particulars are required only for judgments of conviction issued on the merits of the case, unlike the challenged judgment—in its ruling concerning the appellants—which falls solely within the category of procedural judgments.

Original Arabic judgment citations
