English translation of the principle
Summary: - Non-attendance of the lawyer retained by the accused and the court’s appointment of another lawyer who pleaded in the case. This does not constitute procedural invalidity or prejudice to the right of defence, provided that the accused did not object to this procedure and did not insist on requesting an adjournment until his lawyer attended. Consequence: the complaint that the appointed lawyer did not secure a genuine defence for him is inadmissible. Reason: counsel’s preparedness or lack of preparedness is entrusted to his own assessment, as dictated by his conscience, diligence and professional traditions. - Procedures are presumed valid. No allegation contradicting what is recorded of them in the hearing minutes may be made except by a challenge alleging forgery. Rule: Whereas it is apparent from the papers that the appellant submitted a memorandum of his defence before the Court of First Instance and, before the appellate court, that his retained lawyer did not attend, the court appointed a lawyer to defend him. It then confronted the appellant with the charge against him, which he denied. The appointed lawyer pleaded in the case and then requested, primarily, acquittal and, alternatively, leniency. The established principle is that, where the lawyer retained by the accused does not attend and the court appoints another lawyer who pleads in the case, this entails no procedural invalidity and does not prejudice the accused’s right of defence, provided that the latter does not object to this procedure and does not insist before the court on requesting an adjournment until his retained lawyer attends—as in the present case. Accordingly, what the defence raises in this respect is unfounded. Nor is there any basis for the contention that the appointed lawyer did not secure a genuine defence for him, since counsel’s preparedness or lack of preparedness is entrusted to his own assessment, as dictated by his conscience, diligence and professional traditions. That being so, and whereas the minutes of the hearing of 28/3/2012 before the Court of Appeal, at which the case was reserved for judgment, establish that the appellant attended in person, and those minutes do not state that he or another deputising lawyer requested an adjournment until the retained lawyer attended—as indicated in his grounds of appeal—and whereas procedures are presumed valid and no allegation contradicting what is recorded of them in the hearing minutes may be made except by a challenge alleging forgery, which the appellant did not pursue, the complaint against the judgment alleging prejudice to the right of defence in this respect is therefore inadmissible.

ًOriginal Arabic judgment citations
