English translation of the principle

Summary: - Non-attendance of the lawyer retained for the accused and the court’s appointment of another lawyer who pleaded for him do not constitute prejudice to the right of defence, provided that the accused did not object and did not insist before the court on adjourning consideration of the case until his retained lawyer attended. There is no basis for complaining that the appointed lawyer did not secure a genuine defence for him. Counsel’s preparedness or lack of preparedness is entrusted to his assessment, as suggested by his conscience, diligence and professional traditions. Rule: Whereas the minutes of the hearing of 21/10/2013 before the Court of Appeal establish that the court appointed a lawyer to defend the appellant, who pleaded in his defence as recorded in the hearing minutes, and it was not established that the appellant objected or made any requests in this regard, and whereas it is established that, where the lawyer retained for the accused does not attend and the court appoints another lawyer who pleads in the case, this does not prejudice the right of defence provided that the accused does not object to this procedure and does not insist before the court on adjourning consideration of the case until his retained lawyer attends, what the appellant raises in this respect is unfounded. There is no basis for his contention that the appointed lawyer did not secure a genuine defence for him, since counsel’s preparedness or lack of preparedness is entrusted to his own assessment, as suggested by his conscience, diligence and professional traditions.
