Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 210

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The prohibition on a non-Kuwaiti engaging in commerce unless he has a Kuwaiti partner. This is the general rule. The exceptions to it: funds he deposits with banks or companies, or agreements he concludes with them to invest those funds for his account in dealings in foreign currency and precious metals, whenever this falls within their objects. This includes limited liability companies. - The specific does not repeal the general but constitutes an exception to it. Example concerning the inclusion of the word companies among those whom the legislature permitted to deal with foreigners in investing their funds under the Commercial Code, and its characterization as an exception to the prohibition imposed on limited liability companies under the Companies Law.
