Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 260

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Entitlement to default interest, whether statutory or contractual, depends on the debt that the debtor delayed paying arising from a commercial obligation or a commercial act. Contravention of this entails absolute nullity because it concerns public policy. Example. - A commercial act is what a person undertakes with the intention of speculation, even if he is not a merchant. - No interest is payable in respect of a civil act. The reason for this.
