Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2637

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The contract of carriage imposes on the carrier the obligation to deliver the goods sound and complete, in the described condition in which they were handed over to it, at the port of destination. If they sustain damage, the carrier must compensate for it unless evidence is adduced negating this liability. The court of merits is not at fault for refusing to appoint an expert to assess compensation. Example.
