Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2738

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Decrees and decisions issued by the State during and after the Iraqi invasion to protect the public interest, the State’s economic system, and the integrity of banknotes. Their issuance by the State as a governing authority, not an administrative authority, and they are considered acts of sovereignty beyond the review of the judiciary and arbitral tribunals. Example concerning Decree 2 of 1990 concerning the Central Bank’s non-liability for the value of the country’s currency stolen by the occupation authorities and put into circulation after the invasion.
