Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 325

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Anyone who receives something not due is obliged to return it. It makes no difference whether its not being due arises from the facts themselves or from a legal consideration. - The appellant's insistence that the two respondents be obliged to return what they received without right because they failed to fulfil their obligation to sign the sale contract, thereby enriching themselves without lawful cause at his expense. Establishment of the contract's absolute nullity because it included a contract for the sale of a business that was not executed in an official instrument. The challenged judgment's dismissal of the action on the ground that enrichment rules may not be applied because a contractual relationship exists. An error in applying the law that prevented it from giving the action its correct legal characterization.
