State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The requirement that the Kuwaiti partners’ proportion of the capital must not be less than 51% of the company’s capital. This requirement is incompatible with the nature of an undisclosed partnership, because it lacks legal personality and a separate patrimony and has no capital capable of division among the partners in specified proportions.
