Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3810

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Inadmissibility of any claim or defence in which its proponent has no existing interest recognized by law. - Absence of an interest in an appeal in cassation where it is based on an unproductive aspect or a ground which, even if valid and requiring cassation of the judgment, would bring no benefit to the appellant. - A loan contract is binding on both parties and creates reciprocal obligations on the part of both lender and borrower, which requires the existence of two separate patrimonies. The combination of the capacities of lender and borrower in one person. This does not constitute a loan contract. An example of an unproductive ground of challenge.
