Kuwait Court of Cassation principle number 4016
State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
A fixed-term contract. Its condition: the future event certain to occur by which the contract ends must be precisely specified so as to eliminate uncertainty concerning it. - Concluding a contract for a fixed term and agreeing therein that it may be renewed for similar terms without specifying the number of renewals. It is regarded as being of indefinite duration from its inception. The reason therefor: the future event by which the contract will end, whose occurrence does not depend on the will of either party, was not specified to an extent eliminating uncertainty concerning it, making it impossible to ascertain the time designated by the contracting parties for the contract to end.
Arabic original
Original Arabic judgment citations
