Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4361

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A request or defence submitted to the trial court, upon which a determination is unequivocally requested, and which could change the outcome of the case: the court must address it. Failure to do so. Its judgment is considered devoid of reasons and tainted by invalidating inadequacy. An example: concerning the trial court’s failure to address the Labour Relations Department investigator’s acknowledgment of the appellant’s entitlement to an end-of-service gratuity.
