An agent's failure to disclose his capacity in contracts he concludes with third parties. Does not in itself indicate that his agency is a sham. The offence of issuing a cheque without funds is committed by the drawer even if he was authorized as agent to issue it, and he is deemed a principal perpetrator thereof. The reason for this.
