Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 763

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A cheque is an instrument of payment until the contrary is proved and it is proved to be an instrument evidencing a debt. The basis thereof is that freedom from liability is presumed until evidence establishes indebtedness. The burden of proving that delivery of the cheque was by way of lending to the person in whose favour it was drawn or to whom it was endorsed lies on the person alleging this.
