Acceptance of cheques in satisfaction of a debt despite knowledge that they have no covering funds, and exemption from guarantee liability. Its effect. Extinction of the debt and discharge therefrom without being contingent on collection of the value of the cheques. - Payment of the value of cheques in a felony case is not performance of a natural obligation but avoidance of criminal consequences, and is considered a payment not due that may be recovered. - 145 - Commercial

قبول شيكات استيفاء لدين رغم العلم بعدم وجود رصيد لها والإعفاء من الضمان. أثره. انقضاء الدين وبراءة الذمة منه دون التوقف على تحصيل قيمة الشيكات. - الوفاء بقيمة الشيكات في جناية ليس وفاء لالتزام طبيعي وإنما توقيا للأثار الجزائية ويعتبر دفعاً لغير المستحق يحق استرداده. - ١٤٥ - تجاريOriginal Arabic judgment citations
