Article 105 of Civil Code

1 - A prodigal has capacity to dispose of the property allocated for his maintenance within the same limits as the capacity of a discerning minor to dispose of maintenance property provided for in Article 93. 2 - Upon the application of the prodigal, his curator, or any other interested person, the court shall assess the amount of property to be allocated for the prodigal's maintenance, taking into account his resources and his needs and those of his dependants. 3- If there are serious grounds for fearing that the prodigal will squander the maintenance property, the court may withhold that property from him and entrust it to whoever it considers suitable to undertake expenditure on him and his family.
