English translation
In the absence of a provision, the judge shall determine when a moral duty is considered a natural obligation, taking into account the general consciousness of the community. In all cases, no natural obligation contrary to public order may arise.

يقدر القاضي، عند عدم النص ، متى يعتبر الواجب الأدبي التزاما طبيعيا، مراعيا في
ذلك الوعي العام في الجماعة، وفي كل حال لا يجوز أن يقوم التزام طبيعي يخالف
