Article 453 of Civil Code

1 - The defence that an action is barred from being heard by lapse of time may not be waived before the right to it has arisen, nor may an agreement prescribe a period barring the hearing of an action different from that specified by law. 2 - However, a person having capacity to dispose of his rights may waive the defence, even implicitly, after the right to it has arisen, provided that this waiver shall not be effective against creditors if made to their detriment.
