۱ - يجوز البيع تولية أو إشراكا أو مرابحة أو وضيعة, إذا كان الثمن الذي اشترى
به البائع معلوماً وقت العقد, وكان مقدار الربح في المرابحة ومقدار الخسارة في
الوضيعة محدداً.
- فإذا ثبت أن الثمن الذي اشترى به البائع أقل مما ذكره, كان للمشتري أن
يتمسك بالثمن الحقيقي.
- ويعتبر تدليسا كتمان البائع ملابسات أحاطت بشرائه, إذا كان من شأنها أن
تؤثر في رضاء المشتري.
