Article 77 of Civil Code

1 - Impossibility of performing the obligations arising from the contract for a cause attributable to a contracting party shall be deemed equivalent to his exercise of the option to withdraw from the contract, and his liability shall be determined by the amount of the earnest money, in accordance with Article 75. 2 - If impossibility of performing the obligations arising from the contract is attributable to an extraneous cause beyond the control of either contracting party, the earnest money must be returned to its payer.
