Article 816 of Civil Code

1 - If a condition prohibiting or restricting disposition is valid, and the person subject to the condition makes a disposition contrary to it, both the stipulator and the person for whose benefit the condition was established may annul the disposition. 2 - Nevertheless, a disposition contrary to the condition shall be valid if ratified by the stipulator, unless the condition was established for the benefit of a third party.
