Article 925 of Civil Code

1 - If the person who lost possession had not possessed for three years at the time of its loss, he may recover possession only from a person who does not rely on possession having a better claim to preference. Possession having a better claim to preference is possession based on a legal instrument. If neither possessor has an instrument, or their instruments are equal, the possession having a better claim to preference is the earlier in date. 2 - If possession was lost by force, however, the possessor may in all cases recover his possession from the aggressor within the following three years.
