English translation
If the owner of two separate immovable properties establishes an apparent relationship of subordination between them such as would indicate the existence of an easement if they were owned by two different persons, and the two properties subsequently become owned by two different persons without any change in the existing situation, the easement shall be deemed established between the two properties, unless there is an express stipulation to the contrary. إذا أنشأ مالك عقارين منفصلين علاقة تبعية ظاهرة بينهما من شأنها أن تدل على
وجود ارتفاق لو أنهما كانا مملوكين لشخصين مختلفين، ثم أصبح العقـاران مملوكين
لشخصين مختلفين دون تغيير في الوضع الذي كان قائما ، عد الارتفاق مرتبا بين
