Article 963 of Civil Code

1 - The expenses of works necessary for the exercise and preservation of an easement shall be borne by the owner of the dominant property, unless otherwise stipulated. 2 - If the owner of the servient property is obliged to carry out those works at his own expense, he may free himself of that obligation by relinquishing all or part of the servient property to the owner of the dominant property. - If the works also benefit the owner of the servient property, the maintenance expense shall be borne by both owners, each in proportion to the benefit accruing to him.
