Article 104 مكرر of Code of Criminal Procedure and Trials

The victim of a felony or misdemeanour, or any of his heirs, even if he has not brought a civil claim, may submit a grievance against the decisions to close the case referred to in the preceding Articles, within two months from the date on which he is notified of or becomes aware of the decision to close the case, before the Criminal Court or the Misdemeanours Appeals Court, as the case may be. The court, sitting in chambers, shall determine the grievance within thirty days from the date of its submission, by a decision that may not be challenged by any means. Before issuing its decision, it may hear the statements of whomever it considers necessary to hear, or instruct the competent investigating authority to remedy any deficiency in the investigation or complete the papers. If the grievance is upheld on the merits, the case shall be submitted to the competent court within ten days from the date the papers are returned to the authority that issued the decision challenged by the grievance. In all cases, the decision issued on the grievance shall state its reasons. The investigating authority shall submit cases in which decisions to close the case have been issued, and in which the victim or his heirs are unknown, to the competent court for consideration, in accordance with the procedures provided for in the preceding paragraphs.
