Article 213 مكرر of Code of Criminal Procedure and Trials

A petition for reconsideration of final judgments imposing punishment in felony and misdemeanour matters may be made in the following cases: 1- If the accused was convicted of murder and the person alleged to have been killed is subsequently found alive. 2- If a judgment was issued against a person for an incident and a judgment was subsequently issued against another person for the same incident, and there is a contradiction between the two judgments from which the innocence of one of the two convicted persons may be inferred. 3- If a witness or expert is sentenced to the punishment prescribed for false testimony in Part Three of the Penal Code, or if a paper submitted during the hearing of the case is adjudged to have been forged, and the testimony, expert's report or paper had an influence on the judgment. 4- If the judgment was based on a judgment issued by a civil court or by a personal status court and that judgment was set aside. 5- If, after the judgment, facts occur or emerge, or papers are submitted that were unknown at the time of trial, and such facts or papers would establish the innocence of the convicted person.
