Article 213 مكرر 1 of Code of Criminal Procedure and Trials

In the cases stipulated in the first four clauses of the preceding Article, the Public Prosecutor, the General Department of Investigations, the convicted person or his legal representative if he lacks legal capacity or is missing, and his relatives and spouse after his death, shall each have the right to petition for reconsideration. The petition shall be submitted to the Public Prosecutor by an application specifying the judgment for which reconsideration is sought and the ground on which it relies, accompanied by supporting documents. The Public Prosecutor shall refer the petition, together with any investigations he has considered appropriate to conduct, to the Court of Cassation or to the Court of Appeal sitting as a cassation bench in respect of final misdemeanor judgments, with a report stating his opinion and the reasons on which it is based. The application must be referred to the court within the three months following its submission.
