يجوز للمحقق ان يخلى سبيل المتهم المقبوض عليه بتعهد او بدون تعهد، إذا لم يــر

(۲) مضافة بالقانون رقم 3 لسنة ٢٠١٢
داعيا لحبسه ، اما إذا وجد ان الظروف تستلزم بقاءه محبوسا، أصدر امره بحبسه
احتياطيا.
