English translation
Four matters are required of a person pronouncing divorce: 1 - That he has reached puberty; divorce by a person who has not reached puberty is not valid, even if his guardian permits him to do so. 2 - That he is of sound mind; divorce by an insane person is not valid, even if his insanity is periodic, while he is in a period of insanity. If, however, he is in a period of lucidity, it is valid. - That he acts voluntarily and is not coerced; divorce by a coerced person is not valid. - That he intends and desires the divorce; divorce by a person lacking intent is not valid.

يعتبر في المطلق أربعة أمور :
١ - أن يكون بالغا، فلا يصح طلاق غير البالغ، حتى لو أذن له وليه بذلك.
٢ - أن يكون عاقلا ، فلا يصح طلاق المجنون وإن كان إدواريــا وهـو في دور جنونه،
أما إذا كان في دور إفاقته فيصح.
- أن يكون مختارا غير مكره، فلا يصح طلاق المكره.
- أن يكون قاصدا مريدا للطلاق، فلا يصح طلاق غير القاصد.Ask about this article
