English translation
Duress is established by three matters: 1 - The coercing person must be dominant and capable of carrying out what he promises. - The coerced person must be overpowered and unable to avert the threatened harm by flight, resistance or seeking assistance from others, while knowing or strongly believing that if he refrains from carrying out what the coercing person demands of him, the harm will befall him. - What the coercing person threatens must be harmful to his person, property or honour, or to someone whose welfare concerns him.

يتحقق الإكراه بأمور ثلاثة:
1 - أن يكون المكره غالبا قادرا على تنفيذ ما يعد به.
- أن يكون المكره مغلوبا عاجزا عن دفع الضرر المتوعد بـه، بفرار أو مقاومة أو
استعانة بالغير، مع علمه أو غلبة ظنه بأنه لو امتنع عن تنفيذ ما يطلبه منه المكـره
وقع به المكروه.
- أن يكون ما توعده به المكره مضرا في نفسه أو ماله أو عرضه أو من يهمه أمره.Ask about this article
