English translation
Where a missing person has ceased to send news to his family and his wife does not know whether he is alive or dead, and the husband has property from which she is maintained, or his guardian maintains her from his own property, the wife must be patient and wait. She may not demand divorce so long as she is maintained from her husband's property or from his guardian's property, even if the period is prolonged.

المفقود المنقطع خبره عن أهله ولا تعلم زوجته حياته ولا موته، ويكون للزوج
مال ينفق منه عليها ، أو يقوم وليه بالإنفاق عليها من مال نفسه، يجب على الزوجة
الصبر والانتظار ، وليس لها المطالبة بالطلاق ما دام ينفق عليها من مال زوجها أو
