English translation
Where a missing person's family has ceased to receive news of him, his wife knows neither whether he is alive nor whether he is dead, the husband has no property from which maintenance may be provided for her, and his guardian does not maintain her from his own property, she may submit her matter to the judge. He shall grant her a period of four years and order a search for him during that period. If the four years expire without his life or death being established, the judge shall order his guardian to divorce her. If he does not proceed with the divorce, he shall compel him to do so. If compelling him is not possible, or he has no guardian, the judge shall divorce her in accordance with the Jaafari school. She shall then observe a waiting period of four months and ten days. Upon completing the waiting period, she becomes a stranger to her husband and may marry whomever she wishes.
