Article 283 of Jaafari Personal Status Law

The subject of a testamentary disposition transferring ownership is subject to the following requirements: 1 It must be owned by the testator. 2 It must have monetary value and be capable of ownership under Sharia, without distinction as to whether the property is a specific asset, a debt owed by another, or a benefit, and, in the case of a specific asset, whether it actually exists or will come into existence. 3 It must be a right capable of transfer and transmission, such as the rights of demarcation and exclusive appropriation. 4 The bequeathed asset must have a lawful, appreciable benefit; thus, a bequest of wine, pigs, or instruments of prohibited amusement and gambling is not valid. 5 The bequeathed benefit must be lawful and intended; thus, a bequest of the benefit of a female singer or instruments of Law Index 1219 Home Page prohibited amusement, for example, is not valid.
