English translation
A condition of a testamentary directive is that what is directed be a permissible act. A will directing the expenditure of his property on assisting oppressors, constructing places of worship for non-Muslims, copying books of misguidance, and the like is therefore invalid.

يشترط في الوصية العهدية أن يكون ما أوصى به عملاً سائغاً فلا تصح الوصية
بصرف ماله في معونة الظالمين وتعمير دور العبادة لغير المسلمين ونسخ كتب الضلال
