English translation
It is required that what is designated as dower be owned by the husband or by the person providing it as dower. If a dower is designated for her and it transpires that it was not owned by the husband or by the person providing it to her, the specified dower is void, and he must pay the dower of a comparable woman.

يعتبر فيما يجعل مهراً أن يكون ملكاً للزوج أو ملكاً لمن بذله مهراً، فلو جعل لها
مهراً وتبين أنه لم يكن ملكاً للزوج ولا لمن بذله لها بطل المهر المسمى ويجب عليه
