English translation
A missing person whose death is probable shall be adjudged dead after four years from the date of his disappearance. In all other cases, determination of the period shall be entrusted to the judge, after inquiries about him to ascertain whether he is alive or dead.

يحكم بموت المفقود الذي يغلب عليه الهلاك بعد أربع سنين من تاريخ فقده ، وفي
جميع الاحوال الاخرى يفوض أمر المدة الى القاضي وذلك بعد التحري عنه المعرفة
