Article 169 of Personal Status Law

a- The child of every wife in a valid marriage shall be attributed to her husband subject to two conditions: 1- The minimum gestation period has elapsed since the marriage contract. 2- It is not established that the possibility of the spouses meeting was precluded by a physical impediment from the date of the contract until Law Index 1154 Home Page Personal Status Law Law No. 51 of 1984 concerning Personal Status birth, or one that arose after marriage and continued for more than three hundred and sixty-five days. If the impediment ceases, the minimum gestation period must have elapsed from the date of its cessation. b- If either of these two conditions is absent, parentage shall not be established except by the husband’s acknowledgment.
